Effective upon purchase.

By purchasing, receiving, installing, possessing, or using any product manufactured or supplied by Tizona Performance ("Company"), the purchaser, installer, owner, and end user (collectively referred to as the "User") acknowledge that they have carefully read, fully understood, and voluntarily accepted the following Terms and Conditions.

These Terms constitute a legally binding agreement between the User and the Company.

If the User does not agree with these Terms, the product must not be purchased, installed, or used.

1. Motorsport Product

Unless expressly stated otherwise in writing, all products manufactured or supplied by Tizona Performance are intended exclusively for competition, motorsport, track use, exhibition, testing, or off-road applications.

The products are not designed, tested, certified, approved, or intended for operation on public roads.

The User accepts sole responsibility for ensuring compliance with all applicable laws and regulations governing the installation and use of the products within their jurisdiction.

2. No Road Approval or Homologation

Unless specifically stated otherwise in writing, Tizona Performance products are not road legal and do not possess any homologation, certification, type approval, TÜV approval, ECE approval, DOT approval, or any equivalent certification required for public road operation.

The Company makes no representation that any product may legally be installed or operated on a street-driven vehicle.

Any decision to install or use the product on a public road is made solely at the User's own risk and responsibility.

3. Professional Installation Required

All products must be installed exclusively by qualified professionals experienced in vehicle modification and motorsport applications.

The Company is solely responsible for manufacturing the supplied component.

The Company assumes absolutely no responsibility for:

  • Incorrect installation.

  • Improper fitment.

  • Poor workmanship.

  • Incorrect torque specifications.

  • Failure to follow vehicle manufacturer procedures.

  • Use of improper hardware.

  • Improper vehicle preparation.

  • Alignment issues.

  • Structural modifications performed by third parties.

  • Electrical modifications.

  • Mechanical modifications.

  • Paint, finishing, or bodywork performed after delivery.

Any installation error immediately transfers full responsibility to the installer and the vehicle owner.

4. Inspection Prior to Installation

The User shall carefully inspect every product immediately upon delivery.

No product shall be installed before verifying:

  • Correct model.

  • Correct application.

  • Physical condition.

  • Completeness.

  • Absence of transport damage.

  • Suitability for the intended vehicle.

Installation of the product constitutes final acceptance that the product was received in satisfactory condition.

The Company shall not be liable for claims relating to products that have been installed, modified, painted, drilled, cut, bonded, or otherwise altered after delivery.

5. Assumption of Risk

The User understands that vehicle modification and motorsport activities involve substantial and inherent risks which cannot be eliminated.

These risks include, but are not limited to:

  • Vehicle damage.

  • Mechanical failure.

  • Material failure.

  • Component fatigue.

  • Loss of vehicle control.

  • Fire.

  • Collision.

  • Serious bodily injury.

  • Permanent disability.

  • Death.

The User voluntarily and knowingly assumes every risk associated with the purchase, installation, transportation, possession, maintenance, and use of the products.

6. User Responsibility

The User accepts full responsibility for:

  • Product compatibility.

  • Proper installation.

  • Vehicle safety.

  • Periodic inspections.

  • Maintenance.

  • Repairs.

  • Hardware selection.

  • Compliance with local laws.

  • Safe operation of the vehicle.

The Company shall have no duty to supervise, inspect, verify, or approve any installation performed by third parties.

7. Public Road Use

The Company expressly prohibits representing its products as street legal unless specifically stated in writing.

If the User installs or operates the product on any public road, highway, or public access area, such use is undertaken entirely at the User's own risk.

The Company shall bear no responsibility for:

  • Traffic violations.

  • Vehicle inspections.

  • Registration issues.

  • Insurance claims.

  • Vehicle impoundment.

  • Regulatory penalties.

  • Criminal or civil liability arising from such use.

8. Release and Waiver of Liability

To the maximum extent permitted by applicable law, the User irrevocably releases, waives, discharges, and covenants not to sue Tizona Performance, its owners, directors, officers, employees, representatives, distributors, dealers, affiliates, suppliers, contractors, successors, and assigns for any claim arising directly or indirectly from the purchase, installation, ownership, possession, transportation, maintenance, or use of any product supplied by the Company.

This release applies regardless of the legal theory asserted, including contract, negligence, strict liability, warranty, statutory claims, or otherwise, except where such exclusion is prohibited by applicable law.

9. Indemnification

The User agrees to defend, indemnify, and hold harmless Tizona Performance from any and all claims, demands, lawsuits, judgments, penalties, damages, liabilities, costs, expenses, and attorney's fees arising out of or relating to:

  • Installation of the products.

  • Improper installation.

  • Improper maintenance.

  • Vehicle modification.

  • Public road use.

  • Racing activities.

  • Mechanical failure.

  • Bodily injury.

  • Death.

  • Property damage.

  • Claims brought by passengers.

  • Claims brought by third parties.

  • Government investigations.

  • Regulatory actions.

  • Insurance disputes.

10. Disclaimer of Warranties

Except where expressly required by applicable law, all products are supplied "AS IS" and "AS AVAILABLE."

The Company expressly disclaims all warranties, whether express or implied, including but not limited to:

  • Merchantability.

  • Fitness for a particular purpose.

  • Non-infringement.

  • Performance expectations.

  • Compatibility with modified vehicles.

Motorsport components are subjected to extreme operating conditions, and no guarantee of durability or service life is provided.

11. Limitation of Liability

To the fullest extent permitted by law, the total cumulative liability of Tizona Performance arising from any claim, regardless of legal theory, shall never exceed the original purchase price paid for the individual product giving rise to the claim.

Under no circumstances shall the Company be liable for:

  • Loss of profits.

  • Business interruption.

  • Vehicle downtime.

  • Loss of racing results.

  • Loss of sponsorship.

  • Loss of commercial opportunity.

  • Indirect damages.

  • Consequential damages.

  • Punitive damages.

  • Incidental damages.

12. Governing Law

These Terms shall be governed and interpreted in accordance with the laws applicable to the jurisdiction in which Tizona Performance is legally established, without regard to conflict of law principles.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, unless mandatory consumer protection legislation provides otherwise.

13. Severability

Should any provision of these Terms be declared invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms constitute the complete and exclusive agreement between the User and Tizona Performance regarding the purchase and use of the Company's products and supersede all prior communications, representations, or understandings.

15. Acceptance

By completing a purchase through the Company's website, authorized dealers, distributors, online marketplaces, invoices, quotations, or any other sales channel, the User expressly confirms that:

  • They have read these Terms in full.

  • They understand the risks associated with motorsport products.

  • They acknowledge that the products are not intended for public road use unless expressly stated otherwise.

  • They accept sole responsibility for installation, inspection, maintenance, and use.

  • They voluntarily waive, to the fullest extent permitted by applicable law, any claim against Tizona Performance arising from the installation or use of the products.

  • They agree to be legally bound by these Terms without reservation.
